The resolutions YouTube actually stores
YouTube keeps a fixed ladder of thumbnail sizes for every video:

Why is max-res missing sometimes? YouTube only generates the 1280×720 version for videos where the uploader provided a custom thumbnail or the source was HD. Older or low-resolution uploads may top out at 640×480.
What can you legally do with a thumbnail?
The thumbnail belongs to the video's creator, like any image someone made. Downloading it for private reference, research, or criticism/commentary is generally uncontroversial; republishing it as your own content is not.
